FortressFire (“Company,” “we,” “us,” or “our”) utilizes its proprietary technology to help assess wildfire ignition risks, monitor potential threats, and protect properties. This Privacy Policy (“Policy”) describes the Personal Information collected by or on behalf of Company through (1) our website available at www.FortressFire.com (the “Site”), (2) portals available via our Site (the “Portal(s)”), and (3) our corresponding mobile applications (the “Apps”) (collectively the “Fortress Offerings”). This Policy explains how Personal Information collected through the Fortress Offerings is used, protected, and shared. If you have questions or concerns about this Policy, please contact us as set forth below.

Privacy laws and guidelines are part of a constantly changing environment.  We reserve the right, at our discretion, to change, modify, add, or remove portions of this Policy at any time.  All changes will be effective immediately upon posting to the Site. Material changes will be conspicuously posted on the Site or otherwise communicated to you. By using, accessing, or downloading the Site, Portals, or Apps after changes are posted, you agree to such changes.

We Collect Data You Provide

Personal Information. You may use or access the Fortress Offerings without submitting Personal Information. If you elect to provide data that personally identifies you (“Personal Information”) such as your name, phone number, address and email address, we will collect, use, and share such Personal Information pursuant to this Policy and applicable law.

Personal Information is required to use certain Fortress Offerings features, for example, to maintain a Portal account, access one of our Apps, contact us via our Contact Us form on the Site (where we may retain your message’s content and our response), receive or request data from us (e.g., catalogs and brochures), and respond to communications from us (e.g., surveys).

Creation of a Portal or App Account.  In order to create a Portal or an App account, you must first complete the appropriate form or application.  To create an account you must provide your name, email address, phone number, and other information prompted upon creation. This data is used to populate a profile within your Portal or App account. 

Marketing Communications.  We may use your email and mailing address to send you promotional and other electronic and hardcopy communications.  If you sign-up for our promotional communications, you will need to submit your email address. We will use this information to provide you with promotional and other electronic communications.  We may use third-party providers to deliver these communications to you. You may opt-out of marketing emails by contacting us at Privacy@FWIG.com. To opt-out of other communications, please contact us as set forth in the “Contact Us” section below. Opting out of marketing communications does not opt you out of other, non-marketing communications from us.

Purchases; Payment Information. Company may use a third-party payment processor, Stripe, Inc. (“Stripe”), to process payments. Accordingly, Stripe will collect your contact information when you pay for Company services, as the case may be, such as your name, e-mail address, phone number and mailing address. Your billing information is also collected and stored by Stripe, Inc. If you are paying by bank debit or credit card, Stripe will collect your credit card number, expiration, three-digit security code and billing zip code. Stripe will share your transaction information with us so that we can track payment status. Stripe will retain your payment information in encrypted form on its servers. Stripe’s privacy policies can be found at https://stripe.com/us/privacy.  Your payment information may be stored by our payment processor(s) as permitted by PCI-DSS and used for recurring billing. We will maintain a record of your purchases that you make for our Fortress Offerings.

Feedback. When you provide comments or feedback about Fortress Offerings, the content on the Fortress Offerings, or our products or services (“Feedback“), we will not treat that Feedback as confidential and we may use that Feedback for any purpose in our sole discretion so long as it does not personally identify you. Feedback will be used without attribution or compensation to you.

Data Automatically Collected

Account Activity.  We may collect data about how you use your account and the Fortress Offerings when you are logged into your account.  For example, we may track the pages you visit, and any activities you perform when you use the Portal, the App or your account.  We may combine this information with other Personal Information we have collected about you.

Cookies & Other Tracking Technologies.

What types of online tracking mechanisms do we use? We may use cookies, web beacons, pixel tags and other tracking technologies (collectively “Cookies”) on our Site and Portals.

What are cookies and web beacons / pixel tags? A cookie is a small text file that our Site and Portals save onto your computer or device when you use the Site and Portals that provides us certain information about your activities. Cookies allow the Site and Portals to remember your actions and preferences and recognize you or your browser, along with some information you provided. Web beacons / pixel tags are small graphics on a webpage that monitor your activity when viewing a webpage. 

Why do we collect Cookies? We use Cookies to:

  • make our Sites and Portals function properly;
  • provide personalized experiences;
  • tailor our interactions with you;
  • help with our marketing efforts;
  • provide us with valuable data and statistics about the usage and effectiveness of our Sites and Portals and to help us improve our Site and Portals; and
  • help us improve our services.

What type of information do Cookies collect? The Cookies on our Site and Portals may collect information such as:

  • IP addresses assigned to the computers and other devices you use;
  • your internet service provider;
  • device ID number;
  • approximate geographic location;
  • browser type;
  • Site pages visited;
  • websites you access before and after visiting the Site or Portal; and
  • data related to how and when you use the Site or Portal.

We may combine information from Cookies with other Personal Information.

How long do Cookies last? A Cookie can either be a “session” Cookie or a “persistent” Cookie. Session Cookies exist only for so long as you are visiting the applicable Site or Portals.  Such Cookies are typically deleted when you exit your web browser. Persistent Cookies exist for a set period of time, for example, up to several months or years. Each time you visit a Site or Portal that has implemented a persistent Cookie, the persistent Cookie is renewed and that Cookie will remain active until its predetermined expiration date. You can manually delete persistent Cookies through your browser settings.

First and Third-party Cookies. Cookies may either be “first-party” or “third-party” Cookies. A first-party Cookie allows your web browser to talk to the actual Site or Portal that you are visiting. A third-party Cookie allows your web browser to talk to a third-party website, such as the source of an ad that appears on the website you are visiting or a third-party analytics provider. We may not have control over how a third-party uses information collected through third-party Cookies.

How do you manage Cookies or opt-out? Most browsers automatically accept cookies. You can disable this function by changing your browser settings, but disabling cookies may impact your use and enjoyment of the Site or Portals. Not all features or functions of the Site or Portal may work properly if you disable Cookies. You cannot disable all Cookies, such as Cookies that are essential to the functioning of the Site or Portals.

Google Analytics.  We use Google Analytics to collect and process information about your use of the Fortress Offerings. Google sets Cookies on your browser or device, and then your web browser will automatically send information to Google. Google uses this information to provide us with reports that we use to better understand and measure how users interact with Fortress Offerings.

We may also implement additional add-on services to Google Analytics, such as Demographics and Interest Reporting, Remarketing with Google Analytics, and Google Display Network Impression Reporting.

Videos; Embedded Content.  The Fortress Offerings may contain videos and embedded content provided by YouTube, Vimeo and other third parties, including visible content and/or feeds scripts embedded in the Fortress Offerings’ code. YouTube, Vimeo and such third parties may collect data about how you interact with such content.  Specifically, our use of YouTube content requires us to implement certain application programming interfaces (APIs) from YouTube, which allow for data collection, disclosure and use by YouTube pursuant to the Google Privacy Policy available here.  In addition, if you are signed into your Vimeo account when you visit our Fortress Offerings, Vimeo may associate information collected when you visit our Site with your account.  By watching the videos and interacting with such content, you agree to the collection and use of such data.  You may revoke YouTube’s access to your data by visiting the Google security settings page available here.  Please see Vimeo’s privacy policy to learn how Vimeo collects, uses and shares Personal Information.

Data from Other Sources

We may obtain data about individuals from various third-party companies and public sources and we may combine that data with other Personal Information. We use this information where permitted by law to enhance our existing data about our users, improve our ability to contact you, and send relevant communications where permitted.

How We Use Personal Information.

We use Personal Information for the following purposes:

As Stated or Agreed to at the Point of Collection.  We may use Personal Information for the purposes stated or agreed-to at the point of collection. For example, we use Personal Information to respond to your questions, comments, or complaints. We may also use Personal Information as requested or consented to by you.

Administration.  We use Personal Information for administrative purposes, such as to inform our business strategies and to understand the demographics and user preferences of the Fortress Offerings.

Fortress Offerings Management.  We use Personal Information for Fortress Offerings management, such as troubleshooting problems, improving the content and functionality of the Fortress Offerings, statistical and other analyses of the Fortress Offerings, and to customize the Fortress Offerings to you and our users.

Access to the Platform.  We use Personal Information to create an account for the Portals and allow you to access the Portals as needed.

Text Messages. When you sign up for an account on the Apps, we may send you a verification code via text message to the telephone number you have provided in order to verify that telephone number. If prompted, you may need to enter that verification code into the Apps in order to complete the account registration process. Message and data rates may apply.

Advertising, Marketing and Communications.  We may use Personal Information to send you promotions or to perform targeted advertising, to notify you of new services or programs, to notify you of new Fortress Offerings features, to notify you of changes to our Terms or this Policy, and for other similar communications. You may opt-out of marketing emails by contacting us at Privacy@FWIG.com.

To Protect Our Rights.  We may use Personal Information to protect our legal rights or interests, or those of other parties, including to bring legal action against you or anyone who may be causing harm to us, our Fortress Offerings, or to other users of the Fortress Offerings.

Disclosure of Personal Information

We do not sell, rent or lease Personal Information to any third party.  We may share Personal Information with the following parties, in compliance with applicable laws:

Employees and Affiliates.  We may share Personal Information with our employees, sister companies, and affiliates who have a need to know the information for our business purposes.

Insurance Providers and Real Estate Agents.  We may share Personal Information with our insurance providers, brokers, carriers, and real estate agents who have a need to know the information for our business purposes. 

Third-Parties and/or Service Providers.  We may share Personal Information with third parties and/or service providers that provide services for us. For example, we may share Personal Information with our subcontractors and vendors to help us offer, host and manage the Fortress Offerings; contractors who assist with our fire mitigation and risk mitigation services, provide targeted advertising and other marketing; improve the content and functionality of the Fortress Offerings; perform data analysis and statistical analysis; troubleshoot problems with the Fortress Offerings; provide public relations; provide email services; provide data processing; and support or provide the security of the Fortress Offerings.

Government Officials / Law Enforcement.  We will cooperate with law enforcement and other governmental agencies, and may disclose Personal Information: (i) if we believe in good faith we are legally required to disclose that Personal Information, (ii) if we are advised to disclose Personal Information by our legal counsel, or (iii) when necessary to identify, contact or bring a legal action against someone who may cause or be causing harm to, or interfering with the legal rights of, Company or any other party.

Professional Advisors.  We may share Personal Information with our professional advisors, such as our attorneys, accountants, financial advisors and business advisors, in their capacity as advisors to Company.

Change in Ownership.  In the event Company is the subject of a change of control or in the event the Fortress Offerings changes ownership, in whole or in part, or in the event of a bankruptcy, receivership or a similar transaction, we may provide Personal Information to the subsequent owner(s).

Other.  We may share Personal Information with third parties when explicitly requested by or consented to by you, or for the purposes for which you disclosed the Personal Information to us as indicated at the time and point of the disclosure (or as was obvious at the time and point of disclosure).

Use and Disclosure of Non-Personal Information

Company may collect, use, share, transfer and otherwise process de-identified and aggregated information that it receives or creates for any purposes in its sole discretion, in compliance with applicable laws. Company is the sole and exclusive owner of such de-identified and aggregated information, including if Company de-identifies Personal Information so that it no longer considered Personal Information under applicable laws.

Information We Do Not Intend to Collect

Sensitive Information. “Sensitive Information” is any data that reveals your racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, or that involves genetic or biometric data or data concerning health or sexual orientation. We do not intend to collect any Sensitive Information from you. Please do not provide Sensitive Information to us.

Children. Fortress Offerings are not directed at children under 18 years of age. We do not knowingly collect, use, or share Personal Information from children under 18. If a parent or legal guardian learns that their child provided us with Personal Information without his or her consent, please contact us and we will make commercially reasonable attempts to delete such Personal Information.

Social Media

We are active on social media, including LinkedIn (“Social Media”). Anything you post on Social Media is public information and will not be treated confidentially. We may post (or re-post) on the Fortress Offerings and our Social Media pages any comments or content that you post on our Social Media pages.

The Fortress Offerings may allow you to connect and share data with Social Media platforms. These features may require us to use cookies, plug-ins, and APIs provided by such Social Media platforms to facilitate those communications and features. The Fortress Offerings may use advertising networks and services offered by Social Media platforms to deliver advertising content. Use of these services requires Social Media platforms to implement cookies or pixel tags to deliver ads to you while you access the Fortress Offerings.

Your use of Social Media is governed by the privacy policies and terms of the providers that own and operate those websites and not by this Policy. We encourage you to review those policies and terms.

Data Security

We use commercially reasonable technical and organizational measures to help secure Personal Information against loss, misuse, and alteration appropriate to the type of Personal Information processed. If a breach of your Personal Information occurs, we will notify you of the breach if required under applicable law.

You understand that no data transmission over the internet or device can be guaranteed to be 100% secure. While we strive to protect Personal Information, we do not guarantee the security of Personal Information and you provide Personal Information at your own risk.

Access from Outside the United States

If you access the Fortress Offerings from outside the United States, please be aware that Personal Information may be transferred to, stored in, and processed in the United States and other countries where we or our service providers operate. The data protection laws of these countries may not provide the same level of protection as the laws in your jurisdictions. Where we transfer Personal Information from the UK, EEA, or Switzerland, we will put in place appropriate safeguards as required by applicable data protection laws. These safeguards may include the EU Standard Contractual Clauses, the UK International Data Transfer Agreement or UK Addendum, and/or other equivalent lawful transfer mechanisms. We will take appropriate steps to ensure that your Personal Information is treated securely and in accordance with this Policy. Copies of safeguards are available upon request.

Third-Party Websites

The Fortress Offerings may link to, or be linked to, websites not controlled by us. We are not responsible for third-parties’ privacy policies or practices. This Policy does not apply to any third-party websites or to any data that you provide to third parties. You should read the privacy policy for each website that you visit.

California Residents

California consumers, including California residents, employees, and those engaged in business-to-business transactions with us (collectively, “California Consumers”), have certain rights regarding their Personal Information under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (CCPA).As a California Consumer, you have the right to request that we disclose to you:

  1. The categories of personal information we have collected about you.
  2. The categories of sources from which the personal information is collected.
  3. The purpose for our collection of personal information.
  4. The categories of third parties with whom we share personal information.
  5. The specific pieces of personal information collected about you.
  6. The categories of personal information that we disclosed about you for a business purpose (and if we have not disclosed your personal information for a business purpose, we will disclose that fact).

For any categories referenced above, we also will provide a list of categories of personal information we have collected at least in the preceding twelve months, by reference to the enumerated category or categories that most closely describe the personal information collected.

As a California Consumer, you have the right to request that we delete any personal information we have collected. You have the right to prevent us from selling/sharing your personal information to any third parties (including our affiliates or subsidiaries) for cross-contextual behavioral advertising. We will not discriminate against you for exercising any of your rights under the CCPA. Data Retention

We will only retain your Personal Information for as long as reasonably necessary to fulfil the purposes for which we collected it, including for the purposes of satisfying any legal, regulatory, accounting, or reporting requirements. To determine the appropriate retention period for Personal Information, we consider the amount, nature, and sensitivity of the Personal Information, the potential risk of harm from unauthorised use or disclosure of your Personal Information, the purposes for which we process your Personal Information and whether we can achieve those purposes through other means, and the applicable legal requirements.

Lawful Basis for Processing Personal Information

Company is the controller and responsible for your Personal Information.

Where applicable data protection laws require us to identify a lawful basis for processing your Personal Information, we will only use your Personal Information where we have a lawful basis to do so. Depending on the circumstances, we may rely on one of the following lawful bases:

Performance of a contract. We may use your Personal Information where this is necessary to provide the Fortress Offerings to you, manage your account, process payments, provide customer support, or take steps at your request before entering into a contract.

Consent. We may use your Personal Information where you have given us consent to do so, including where required for certain marketing communications. You may withdraw your consent at any time by contacting us at Privacy@FWIG.com or through our “Contact Us” page].

Legitimate interests. We may use your Personal Information where this is necessary for our legitimate business interests, provided that those interests are not overridden by your interests, rights and freedoms. This may include operating, improving and securing the Fortress Offerings, understanding how users interact with our services, communicating with users, preventing fraud, and protecting our legal rights.

Legal obligation. We may use your Personal Information where this is necessary to comply with a legal or regulatory obligation, including accounting, tax, reporting, security, law enforcement or other compliance requirements.

Your Legal Rights

Under certain circumstances, you may have rights under data protection laws in relation to your Personal Information. These rights, listed below, are not absolute and may be limited in particular circumstances. We will explain any applicable limitation when responding to your request.

Request access to your Personal Information. You may request confirmation as to whether we process your Personal Information and, if so, a copy of that data. You may also request information about the purposes of processing, the categories of Personal Information, the recipients or categories of recipients, the expected retention period or the criteria used to determine it, the source of the data where it was not collected from you, and the existence of automated decision-making, including profiling, where applicable.

Request correction of your Personal Information. This enables you to ask us to correct any incomplete or inaccurate Personal Information we hold about you. We may need to verify the accuracy of any new data you provide to us and, where required by law, will communicate the correction to recipients to whom the data was disclosed.

Request erasure of your Personal Information. This enables you to ask us to delete or remove Personal Information where there is no good reason for us continuing to process it, where you have successfully exercised your right to object to processing, where we may have processed your Personal Information unlawfully, or where we are required to erase your Personal Information to comply with applicable law. Please note that we may not always be able to comply with your request for erasure for specific legal reasons, such as where retention is necessary to comply with a legal obligation or to establish, exercise or defend legal claims, which will be notified to you where applicable.

Object to processing of your Personal Information. You may object to our processing of your Personal Information where we are relying on a legitimate interest and there is something about your particular situation which makes you want to object. You also have the right to object where we are processing your Personal Information for direct marketing purposes. In some cases, we continue processing your Personal Information where we can demonstrate that we have compelling legitimate grounds to process your Personal Information which override your rights and freedoms or the processing is needed for legal claims.

Request restriction of processing of your Personal Information. This enables you to ask us to suspend the processing of your Personal Information in certain circumstances, including where you want us to establish the data’s accuracy, where our use of the data is unlawful but you do not want us to erase it, where you need us to hold the data to establish, exercise or defend legal claims, or where you have objected to our use of your data and we need to verify whether we have overriding legitimate grounds to use it. Where processing has been restricted, it may still need to be processed for certain purposes such as defence of claims.

Request transfer of your Personal Information (data portability). In certain circumstances, you may ask us to provide your Personal Information to you, or to a third party you have chosen, in a structured, commonly used and machine-readable format where the processing: (i) is based on your consent; and (ii) is carried out by automated means.

Withdraw consent at any time. Where we rely on consent to process your Personal Information, you may withdraw your consent at any time. This will not affect the lawfulness of any processing carried out before you withdrew your consent. If you withdraw your consent, we may not be able to provide certain products or services to you, and we will advise you if this is the case.

Right to Complain

In the UK, you have the right to make a complaint to us at any time and we ask that you raise any complaints with us in the first instance. You can submit any complaints to Privacy@FWIG.com.

You also have the right to lodge a complaint with a supervisory authority, including your local supervisory authority, if you consider that your data protection rights have been infringed. However, we ask that you contact us first so that we can try to resolve any issues with you directly.

How to Exercise Your Rights

If you wish to exercise any of the rights set out above, please contact us at the e-mail or postal address listed in the “Contact Us” section above. Please identify the right you wish to exercise and provide enough information for us to understand and locate your request.

You will not usually have to pay a fee to access your Personal Information or to exercise any of your other rights. However, we may charge a reasonable fee, or refuse to comply with your request, if your request is clearly unfounded, repetitive or excessive.
